LEGAL NOTICE

The Site www.orviai.app and the application Orvi AI are edited by POLIP, SAS with a capital of 3,000 euros, registered with the RCS of Marseille under number 913 696 126, whose registered office is located at 98 rue Château Payan, 13006 Marseille.

ARTICLE 1 – DEFINITIONS

To simplify the understanding of certain terms used herein, the following definitions apply:

• "General Terms of Use" or "GTU": these GTU, governing the legal relationship between Users and Orvi AI.
• "Account": the personal account reserved for each Member registered on the Platform.
• "Personal Data": any information related to an identified or identifiable natural person, in particular by reference to an identifier (name, identification number, location data, online identifier).
• "Orvi AI": the AI search analytics platform managed by POLIP.
• "Members": Users registered and having an Account on the Platform.
• "Platform": Orvi AI, accessible via the Site, offering analysis and optimization services for AI search engines.
• "Privacy Policy": the conditions for collecting and processing Personal Data of Users in compliance with Law 78-17 of January 6, 1978 and the GDPR.
• "GDPR": Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016.
• "Services": all services offered by Orvi AI, including brand visibility tracking, sentiment analysis, and competitor intelligence.
• "Site": www.orviai.app.
• "User": any natural or legal person using the Orvi AI Platform.
• "Free Tier": free access to basic services of the Orvi AI Platform, including limited tracking capabilities.
• "Premium Subscription": paid subscription giving access to advanced features, higher usage limits, and detailed analytics, payable via Stripe.

ARTICLE 2 – PURPOSE AND SCOPE

2.1. The Orvi AI Platform offers Users services to track and improve their brand visibility on AI-powered search engines.
2.2. These GTU define the terms and conditions for using the Platform and the Site. This license to use is granted subject to prior acceptance of the GTU.
2.3. The GTU are supplemented by the Privacy Policy.
2.4. The GTU are accessible at any time from the Site and prevail over any other version.
2.5. The GTU may be modified at any time for legislative or functional reasons.

ARTICLE 3 – ACCESS, REGISTRATION AND PREMIUM SUBSCRIPTION

3.1. Access and Use: Access to the Orvi AI Platform and the use of certain services are free for all Users via the Free Tier.

3.2. Registration: Registration to create an Account is strictly limited to natural persons aged at least 16. Upon registration, the User must provide:

• First Name
• Last Name
• Email Address
• Password

3.3. Premium Subscription: The Premium Subscription, billed according to the current pricing on the Site via Stripe, provides access to advanced AI analytics features.

• Payment: Subscription payment is made via the service provider Stripe.
• Ethical Use of AI: The Premium Subscription is subject to ethical use of AI functionalities. In case of abuse or non-compliant use, Orvi AI reserves the right to suspend or terminate the subscription without notice.
• Cancellation: The Premium Subscription can be canceled by the User at any time via their Account, effective at the end of the current period.

ARTICLE 4 – SERVICES AND FEATURES

4.1. Services for Members:

• Access to AI search visibility analytics.
• Brand sentiment analysis tracking.
• Detailed reports on brand sources.
• Competitor gap analysis.

4.2. Services for Users without an Account:

• Access to public pages of the Site (Landing page, Blog, Pricing).

ARTICLE 5 – USER OBLIGATIONS

Users undertake to:

• Respect the GTU.
• Not copy, reproduce or distribute the content of the Site.
• Not use malicious tools or alter the functionalities of the Site.
• Preserve the security of their credentials.
• Not create multiple Accounts or assign their Account.
• Notify Orvi AI in case of fraudulent use of their Account.
• Use AI functionalities ethically: Any misuse of AI tools within the Premium subscription may result in suspension or termination of the subscription.

ARTICLE 6 – OBLIGATIONS OF ORVI AI

Orvi AI undertakes to:
- Make its best efforts for the proper functioning of the Services.
- Ensure security and confidentiality of access.
- Provide maintenance and assistance services.

Orvi AI is only bound by an obligation of means and cannot guarantee uninterrupted operation of the Site.

ARTICLE 7 – LIABILITY

7.1. User Liability:
The User is responsible for their use of the Site, the information they share, and damages caused by illicit use of the Site.

7.2. Orvi AI Liability:
Orvi AI is not responsible for disputes between Users and third parties, nor for interruptions due to force majeure or causes beyond its control.

ARTICLE 8 - INTELLECTUAL PROPERTY

These GTU do not grant the User any intellectual property rights over the Platform and its content, which remain the property of POLIP. Any reproduction, adaptation or modification of the Site without authorization is prohibited.

ARTICLE 9 – SUSPENSION / DELETION OF ACCOUNT

9.1. Suspension of Account: Orvi AI may suspend an Account for identity theft, non-compliance with GTU, or other reasons related to security and proper functioning.

9.2. Deletion of Account: A User may request the deletion of their Account by sending an email to contact@orviai.app. Orvi AI may also delete an Account in case of serious breach of the GTU.

ARTICLE 10 – OTHER PROVISIONS

10.1. Partial Nullity: If a provision of the GTU is declared invalid, the others will remain in force.
10.2. Applicable Law: The GTU are governed by French law.
10.3. Disputes: Before any legal action, the User agrees to contact Orvi AI for an amicable resolution.
